By accessing or using any services provided by Top G Labs Ltd ("we," "our," "us," or the "Company"), you agree to be bound by these Terms of Service ("Terms"). Our services include:

• Mobile Applications: All apps published by Top G Labs Ltd on any platform (Google Play Store, Apple App Store, etc.)
• Games: All games developed and published by Top G Labs Ltd
• Related Services: Any APIs, SDKs, cloud services, support services, or other digital products we offer

These Terms constitute a legally binding agreement between you and Top G Labs Ltd. If you do not agree to these Terms, you must not access or use our services. These Terms apply globally to all users of our products and services.

2. Definitions

• "Services" refers to all products, applications, games, websites, and services provided by Top G Labs Ltd
• "User," "you," or "your" refers to any individual or entity accessing or using our Services
• "Content" refers to all text, graphics, images, music, software, audio, video, data, and other materials available through our Services
• "User Content" refers to any content you create, upload, or submit through our Services
• "Virtual Items" refers to any in-game currency, items, upgrades, or features purchased or earned within our games
• "Account" refers to your registered user account with any of our Services that require registration

To use our services, you must:

• Be at least 13 years of age (or 16 in the European Union/UK)
• Have the legal capacity to enter into binding agreements
• Comply with all applicable laws and regulations in your jurisdiction
• Provide accurate and complete information when creating an account (for services requiring registration)
• Not be prohibited from using our services under any applicable law

If you are under 18 years of age, you represent that you have your parent's or legal guardian's permission to use our services. Parents and guardians are responsible for monitoring their children's use of our services.

Age Ratings: Some of our games may have specific age ratings as determined by app store guidelines (PEGI, ESRB, etc.). You agree to comply with these age ratings.

4.1 Permitted Use

You may use our services for lawful purposes only and in accordance with these Terms. You are granted a limited, non-exclusive, non-transferable, revocable license to use our services for personal, non-commercial purposes.

4.2 Prohibited Activities

You agree NOT to:

• Violate any applicable local, state, national, or international law or regulation
• Infringe upon our intellectual property rights or the rights of others
• Transmit any harmful, malicious, or destructive code (viruses, malware, etc.)
• Attempt to gain unauthorized access to our systems, accounts, or data
• Interfere with or disrupt the services, servers, or networks
• Impersonate any person or entity or misrepresent your affiliation
• Collect or harvest information about other users without consent
• Use our services to spam, harass, abuse, threaten, or harm others
• Reverse engineer, decompile, or disassemble any part of our services
• Use automated systems (bots, scrapers, cheats) without permission
• Exploit bugs, glitches, or vulnerabilities for unfair advantage
• Buy, sell, or trade accounts, virtual items, or in-game currency outside of official channels
• Use cheats, hacks, mods, or unauthorized third-party software
• Engage in any form of real-money gambling within our services (unless explicitly permitted and licensed)
• Remove, circumvent, or disable any security features or protections

5. User Accounts

For services that require registration:

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must immediately notify us of any unauthorized use of your account
• You must provide accurate, current, and complete information during registration
• You must update your information to keep it accurate and current
• You may not share your account with others or create multiple accounts
• You may not use another person's account without authorization

Account Suspension/Termination: We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent or abusive activity, or remain inactive for extended periods.

Account Deletion: You may delete your account at any time through in-app settings or by contacting us. Upon deletion, your data will be handled in accordance with our Privacy Policy.

6.1 Our Intellectual Property

All content, features, functionality, software, designs, graphics, logos, trademarks, characters, game assets, music, sound effects, and other materials on our services are owned by Top G Labs Ltd or our licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Limited License to Users

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use our services for personal, non-commercial purposes
• Download and install our mobile apps on your personal devices
• Play our games in accordance with these Terms

This license does not include the right to copy, modify, distribute, sell, lease, sublicense, or create derivative works from our services or content.

6.3 Your Content

You retain ownership of any content you create, upload, or submit through our services (e.g., usernames, profile information, user-generated content). By submitting content, you grant us a worldwide, royalty-free, non-exclusive, sublicensable license to use, store, reproduce, modify, display, and process your content solely to provide and improve our services.

6.4 Copyright Claims (DMCA)

If you believe that content available through our services infringes your copyright, please contact us at contact@topglabs.co.uk with a detailed description of the alleged infringement.

The following terms apply to all mobile applications published by Top G Labs Ltd:

7.1 App Store Terms

• Apps downloaded from Google Play are subject to Google Play's Terms of Service
• Apps downloaded from Apple App Store are subject to Apple's Terms and Conditions
• App store providers (Google, Apple) are third-party beneficiaries of these Terms
• We, not the app stores, are responsible for our apps and their content

7.2 Offline Applications

• Some apps operate entirely offline without internet connectivity
• Game progress and data are stored locally on your device only
• Uninstalling offline apps will permanently delete all local data
• We are not responsible for loss of data due to device issues, app uninstallation, or device changes

7.3 Online Applications

• Some apps require internet connectivity for account creation, login, and synchronization
• Your data may be stored on our secure servers and synced across devices
• You are responsible for any data charges from your mobile provider
• Service availability may be affected by network conditions

The following additional terms apply to our games:

8.1 Virtual Items and In-Game Currency

• Virtual items and currency are licensed, not sold, to you
• Virtual items have no real-world monetary value and cannot be exchanged for real money
• We may modify, suspend, or discontinue virtual items at any time
• Virtual items may be lost if your account is suspended or terminated
• Transfers of virtual items outside the game are prohibited unless explicitly permitted

8.2 Game Updates and Modifications

• We may update, modify, or patch our games at any time
• Updates may change gameplay mechanics, balance, features, or content
• You may need to update to continue using certain features
• We reserve the right to discontinue any game with reasonable notice

8.3 Fair Play

• You must play fairly and not exploit bugs or use cheats
• Automated gameplay (bots, scripts) is prohibited
• Game manipulation or match-fixing is prohibited
• We may take action against accounts suspected of cheating

For any paid features, subscriptions, or in-app purchases:

• All fees are stated in the currency displayed at the time of purchase
• Payments are processed through third-party payment processors (Google Play, Apple App Store, Stripe, etc.)
• We do not directly collect or store your payment card information
• All purchases are final unless otherwise required by applicable law
• Subscriptions automatically renew unless cancelled before the renewal date
• You can cancel subscriptions through your app store account settings
• Refunds are subject to the policies of the respective app store platform
• We reserve the right to change pricing with notice to existing subscribers
• You are responsible for any applicable taxes

Unauthorized Purchases: If you believe an unauthorized purchase was made using your account, contact us immediately at contact@topglabs.co.uk.

Our services may contain links to or integrate with third-party services, including:

• Advertising networks (Google AdMob, Unity Ads, etc.)
• Analytics providers (Firebase, Google Analytics)
• Social media platforms
• Authentication providers (Google Sign-In, Apple Sign-In)
• Cloud service providers

We are not responsible for the content, privacy practices, or availability of third-party services. Your use of third-party services is subject to their own terms and policies. We encourage you to review their terms before using them.

11. Privacy

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, protect, and share your information. By using our services, you consent to the collection and use of your information as described in our Privacy Policy. Our Cookie Policy explains our use of cookies and similar technologies on our website.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED
• WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES
• WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT
• YOUR USE OF OUR SERVICES IS AT YOUR OWN RISK

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• WE ARE NOT LIABLE FOR LOSS OF DATA, PROFITS, REVENUE, BUSINESS OPPORTUNITIES, OR GOODWILL
• WE ARE NOT LIABLE FOR LOSS OF VIRTUAL ITEMS, IN-GAME PROGRESS, OR GAME DATA
• WE ARE NOT LIABLE FOR ANY DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR (B) £100

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. If these laws apply to you, some of the above limitations may not apply, and you may have additional rights.

14. Indemnification

You agree to indemnify, defend, and hold harmless Top G Labs Ltd, its officers, directors, employees, agents, licensors, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to:

• Your use of our services
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content
• Any claims brought against us by third parties as a result of your actions

15. Termination

By Us: We may terminate or suspend your access to our services immediately, without prior notice or liability, if you:

• Violate these Terms or our Privacy Policy
• Engage in fraudulent, abusive, or illegal activity
• Fail to pay required fees (if applicable)
• Create risk or legal exposure for us

By You: You may terminate your account at any time by:

• Deleting your account through in-app settings
• Contacting us at contact@topglabs.co.uk
• Uninstalling our apps from your devices

Upon termination, your right to use the services will cease immediately. We may delete your account data in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination will survive (including intellectual property, disclaimers, limitations of liability, and indemnification).

16. Dispute Resolution and Governing Law

Governing Law: These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Jurisdiction: Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales. However, nothing in these Terms prevents you from bringing proceedings in your country of residence if permitted by applicable consumer protection laws.

Informal Resolution: Before filing a formal claim, you agree to contact us first to attempt to resolve the dispute informally at contact@topglabs.co.uk. We will try to resolve disputes within 60 days.

EU/UK Consumers: If you are a consumer in the EU or UK, you may also make use of the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

17. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If we make material changes, we will notify you by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Sending an email notification (for significant changes, where we have your email)
• Displaying a notice in our apps (for significant changes)

Your continued use of our services after changes become effective constitutes acceptance of the new Terms. If you do not agree to the changes, you must stop using our services and, if applicable, delete your account.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Top G Labs Ltd regarding your use of our services and supersede all prior agreements and understandings.

18.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by us.

18.4 Assignment

You may not assign or transfer these Terms or your rights without our prior written consent. We may assign our rights and obligations without restriction.

18.5 Force Majeure

We shall not be liable for any failure to perform our obligations where such failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, government actions, or system failures.
